An Act to amend the COVID-19 Act 2020.
The Parliament of the Cook Islands enacts as follows—
This Act is the COVID-19 Amendment Act 2020.
This Act comes into force the day on which it receives the assent of the Queen’s Representative.
This Act amends the COVID-19 Act 2020 (the principal Act).
After section 30 insert:
“31 Section 9A notices under the Entry, Residence and Departure Act 1971-72
“(1) For the purpose set out in section 3, the Minister of Foreign Affairs and Immigration may, when issuing a notice under section 9A of the Entry, Residence and Departure Act 1971-72, use the notice to —
- “(a) deny entry to any person or category of persons (including Cook Islanders, Permanent Residents or children of Permanent Residents), despite section 4 of that Act; and
- “(b) impose any conditions of entry for any person or category of persons (including Cook Islanders, Permanent Residents or children of Permanent Residents) who are the subject of the section 9A notice.
“(2) The notices described in subsection (3) must—
- “(a) be treated as having been validly made under section 9A of the Entry, Residence and Departure Act 1971-1972; and
- “(b) be treated as if section 4 of that Act were not in force at the time they were issued; and
- “(c) for the duration of the notice, be treated as if section 4 of that Act does not have any effect.
“(3) The notices issued by the Ministry of Foreign Affairs and Immigration pursuant to section 9A of the Entry, Residence and Departure Act 1971-1972 on—
- “(a) 31 January 2020; and
- “(b) 27 February 2020; and
- “(c) 16 March 2020; and
- “(d) 17 March 2020; and
- “(e) 24 March 2020.
“(4) To avoid doubt, sections 9(1)(ba) and 9B of the Entry, Residence and Departure Act 1971-72 applies to any notice—
“(a) issued pursuant to section 9A of that Act and subsection (1) of this section; and
“(b) described in subsection (3).
“(5) Ani notove cd brethis sectisection will automatically expire on the repeal of this Act and can be revoked by the Minister of Foreign Affairs and Immigration at any time.”
