An Act to amend the Crimes Act 1969
(12th November 2007
BE IT ENACTED by the Parliament of the Cook Islands in Session assembled and by the authority of the same as follows:
1. Short Title - This Act may be cited as the Crimes Amendment Act 2007 and shall be read together with and deemed part of the Crimes Act 1969 (hereinafter referred to as "the principal Act").
2. Abolition of death penalty - Section 76 of the principal Act is amended by deleting from sub-section (2) the word "death" and substituting "life imprisonment".
3. Consequential amendments - (1) The Criminal Procedure Act 1980-81 is amended by -
(a) Deleting the words "by death or" from section 4(2);
(b) Deleting the words "death or" from sections 4(3)(a), 5(a), 81(b), 83(1), and 83(4);
(c) Repealing sections 119 and 120, and the Second and Third Schedules.
(2) The Judicature Act 1980-81 is amended by deleting from section 58, the words "or unless the appellant has been sentenced to death."
