An Act to amend the Local Government Act 1966

BE IT ENACTED by the Legislative Assembly of the Cook Islands in Session assembled, and by the authority of the same, as follows:
This Act may be cited as the Local Government Amendment Act 1973-74 and shall be read together with and deemed part of the Local Government Act 1966 (herein-after referred to as "the principal Act").
Section 5 of the principal Act is hereby amended by repealing subsection (1) and substituting the following new subsection:
"(1) The Rarotonga Island Council shall consist of the members of the District Councils on Rarotonga elected pursuant to the provisions of section 41 of this Act."
The principal Act is hereby further amended by repealing section 41 and substituting the following section:
"41 (1) There shall be in each District a Council known as the District Council constituted as follows:
- (a) All Arikis who traditionally derive their title within the District;
- (b) A representative of the members of the Koutu-Nui who derive their titles within the District, who shall be elected by those members at a meeting called for that purpose in January of each year;
- (c) The Legislative Assembly members representing constituencies in that District;
- (d) The following elected members, who shall be elected in accordance with the provisions of the Local Government Electoral Regulations 1968;
- (i) Three members from the Takitumu District;
- (ii) Four members from the Te-Au-O-Tonga District;
- (iii) Three members from the Puaikura District;
- (e) Not more than two members from each Village Committee within the District, such members to be nominated by the Village Committee in January of each year.
(2) The persons holding office in the District Council by virtue of paragraphs (a), (b) and (c) of subsection (1) of this section shall have no right to vote at any meeting of the District Council.
(3) For the purposes of the Local Government Electoral Regulations 1968 each District shall constitute a constituency.
Notwithstanding anything herein contained, for the purpose of the constitution of the District Councils for the period from the date of the commencement of this Act to the 31st December 1974 the persons to hold office as -
(a) The representatives of the Koutu-Nui shall be elected at meetings of the members concerned to be held within four weeks of the date of the commencement of this Act.
(b) The elected members shall be the persons holding similar office in the District Council immediately before the commencement of this Act.
(c) Members nominated by the Village Committees shall be nominated by the Village Committees within four weeks of the date of the commencement of this Act.
This Act is administered in the Ministry of Social Services.
