An Act to amend the Outer Islands Local Government Act 1987
(1 May 1989
BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:
(1) This Act may be cited as the Outer Islands Local Government Amendment Act 1989 and shall be read together with and, deemed part of the Outer Islands Local Government Act 1987 (hereinafter referred to as "the principal Act").
(2) Section 2 of this Act shall be deemed to have come into force on the 18th day of December 1987 (being the date of commencement of the principal Act).
(1) The First Schedule to the principal Act is amended by adding to the first, second and third columns, the name of the island, constituencies and number of elected members set out in the Schedule to this Act.
(2) Consequent upon the First Schedule to the Principal Act being amended in the manner referred to in subsection (1), section 3 of the Principal Act is amended by deleting the words "Pukapuka and Nassau".
The principal Act is amended by adding after section 7 the following new section:
"7A. Nassau Island Committee
(1) There is hereby established a committee to be known as the Nassau Island Committee.
(2) The Committee shall consist of 3 members (one of whom shall be appointed as Chairman) from time to time appointed by the Aronga Mana and the Island Council of Pukapuka following consultation with each other.
(3) The functions of the Committee shall be
- (a) To advise and make recommendations to the Aronga Mana and the Island Council of Pukapuka on matters affecting the Island of Nassau including policies and rules based on local customs affecting the island.
- (b) To assist in implementing any decision of the Pukapuka Island Council affecting the island of Nassau.
(4) For the purposes of clarification it is hereby declared that the jurisdiction of the Pukapuka Island Council shall extend to the island of Nassau provided however that the Council shall have regard at all times to advice and recommendations tendered to it pursuant to subsection (3)(a).
(5) The members of the Nassau Island Committee shall be paid such remuneration and expenses as may from time to time be determined by the Island Council out of monies appropriated by Parliament for that purpose."
Every resolution passed, every act done and every payment made purporting to have been passed done or made in the name of or on behalf of the Pukapuka Island Council before the passing of this Act which could have been validly passed done or made pursuant to the provisions of the principal Act but for the passing of this Act is hereby declared to be and always to have been validly passed done or made.
(2) Every resolution, every act and every payment that could have been either passed done or made pursuant to the provisions of the principal Act but for the passing of this Act shall as from the commencement date of this Act be capable of being passed done or made as the case may be and if so passed done or made shall take effect on the date that it would have been passed done or made but for the passing of this Act.
