PURSUANT to Section 92 of the Marine Resources Act 2005 and Section 25 of the Marine Resources (Long Line Fishery) Regulations 2008, the Queen's Representative, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

Regulations to amend Schedule 3 of the Marine Resources (Longline Fishery) Regulations 2008

1. Title and commencement - (1) These regulations may be cited as the Marine Resources (Longline Fishery) Amendment Regulations 2010, and shall be read together with and deemed part of Marine Resources (Longline Fishery) Regulations 2008 (hereinafter referred to as "the principal Regulations").

(2) These regulations shall come into force on the day they are assented to by the Queen's Representative.

2. Schedule Amended – Schedule 3 of the principal Regulations is hereby amended by deleting "$2500", "Under 18 Metres", and "18 metres and over", in the table in paragraph 4; and substituting "$2000", "Under 20 Metres", and "20 metres and over" respectively.

where the requirements for a vessel to be considered as locally-based are:

(a) the vessel is fully operated from Cook Islands;

(b) the vessel fishes mainly in Cook Islands waters; and

(c) the vessel lands all or a substantial part of its catch in Cook Islands.

Fishing licence for foreign vessels:

Unloading incentive rebate for foreign fishing vessels unloading/landing at least 20mts in Cook Islands in the previous licensing year.*

* Note: the rebate is payable on submission of documentation required by the Secretary
All unloaded/landed catch must be of an approved standard (i.e HACCP) and must be handled by an established and licensed fish processing/storage facility.
