The decision in this case depended on the decision in case 4/95 the subject of the appeal in 21/98. We have sent that back for rehearing and a fresh determination of the boundary. It follows that this decision in NT 5/98 cannot stand either. We therefore send it back to the magistrates for a fresh determination of the boundary.
