High Court of Kiribati |
IN THE HIGH COURT OF KIRIBATI
CRIMINAL JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI
HIGH COURT CRIMINAL CASE No. 13 OF 2005
THE REPUBLIC
vs
ANTONIO TERIETA
FOR THE REPUBLIC: MS RURIA ITERAERA
FOR THE ACCUSED: MR AOMORO AMTEN
DATE OF HEARING: 13 MARCH 2006
SENTENCE
Antonio Terieta: you have been found guilty of larceny. That is a crime with a maximum penalty of 14 years.
You with two other men in the night took a Yamaha 40 HP engine from a boat in the Betio dock. You tried to sell it for $2,000 but fortunately the owner found it within a few hours and recovered it from the man who had said he would buy it. All you got was $100. It was a bare-faced crime and deserves significant punishment: People ought to be able to leave their things knowing that they will not be stolen.
You are 36 years old, married with two children. You live on Betio. You have been working for the Kiribati Ports Authority.
In 1987 you were convicted of murder and have been on parole for some years. You will be imprisoned for three years from Monday 13 March since when you have been in custody.
Dated the 16th day of March 2006
THE HON ROBIN MILLHOUSE QC
Chief Justice
