Having heard Mr Mweretaka of counsel for the plaintiff and Ms Maitinnara of counsel for the defendant IT IS HEREBY ORDERED that the application is refused and further ORDERED that:

1. File documents already exchanged within 7 days;
2. Parties to settle issues 7 days thereafter;
3. Plaintiff to call one witness; Defendant to call one witness;
4. Evidence of witnesses by affidavit or Statement on Oath to be filed and exchanged 14 days thereafter;
5. Witnesses to attend trial for cross examination if required;
6. Plaintiff to request trial date within 60 days.
