Republic v Nakibwae [2014] KIHC 24; Criminal Case 02.2013 (3 July 2014)

IN THE HIGH COURT OF KIRIBATI 2014

CRIMINAL CASE NO. 2 OF 2013

BETWEEN

THE REPUBLIC
PROSECUTOR

AND

TABOKAI NAKIBAE
ACCUSED

Before: The Hon Justice Vincent Zehurikize

3 July 2014

Mr Taburuea Rubetaake for Prosecutor
Ms Botika Maitinnara for Accused

SENTENCE AND REASONS FOR IT

Zehurikize J: I have considered submissions by both Counsel which I need not set out here save that he is a first offender who has pleaded guilty thereby saving the Court's time and scarce resources. He appears devastated by what happened. He sought reconciliation which was accepted.

In these circumstances I sentence the convict to a fine of $250 to be paid within a month from today and in default to serve one month's imprisonment.

Dated the 3rd day of July 2014

THE HON JUSTICE VINCENT ZEHURIKIZE
Judge
