ORDER

Upon hearing Ms Timeon of Counsel for the plaintiff/applicant and Mr Tentau of Counsel for the defendant/respondent, and upon the defendant/respondent’s undertaking through Counsel, that the subject matter of the dispute, namely the catamaran “Maurin Teraoi 2” will not be sold, removed from the jurisdiction or otherwise dealt with, the Court accepts the Undertaking by Defendant/Respondent and that the Undertaking will remain in effect until the trial of this action or the case is resolved whichever first occurs.
