AN ACT

To make interim provision for the withdrawal and expenditure of moneys from the Treasury Fund and the Nauru Housing Fund in payment for goods and services obtained or ordered for the Republic during the second three months of the financial year ending on the thirieth day of June, One thousand nine hundred and seventy-eight.

Enacted by the Parliament of Nauru as follows:

SHORT TITLE

1. This Act may be cited as the Supply (No. 2) Act 1977.

COMMENCEMENT AND EXPIRY

2. This Act shall come into force on the first day of October One thousand nine hundred and seventy-seven and shall cease to have effect on the thirty-first day of December, One thousand nine hundred and seventy-seven, or upon the coming into operation of the appropriation law in respect of the financial year ending on the thirtieth day of June, One thousand nine hundred and seventy-eight, whichever is the earlier.

WITHDRAWAL OF MONEYS FROM THE TREASURY FUND

3. The amount of Ten million, nine hundred and eighty-nine thousand five hundred dollars ($10,989,500) may be withdrawn from the Treasury Fund and expended as authorised in the Schedule to this Act in payment for goods and services obtained or ordered for the Republic until this Act shall cease to have effect in accordance with section 2.

NAURU HOUSING FUND

4. Where moneys are withdrawn from the Treasury Fund and expended as authorised in the Schedule to this Act for the erection, maintenance and repair of Nauruan housing, the Treasury Fund shall be reimbursed from the Nauru Housing Fund to the extent of that expenditure and the Nauru Housing Fund is hereby charged accordingly.

SUPPLY (NO. 2) BILL 1977

OBJECTS AND REASONS

As the Appropriation Bill 1977 has not been enacted it is Government's intention to call a General Election. The Supply Act 1977 expires on 1st October.

There will not be any authority thereafter to expend moneys for the services of the Republic. It is necessary to provide statutory authority for such expenditure until such time as Parliament, after such General Election, has had opportunity to enact an Appropriation Bill for 1977-78. The Supreme Court opinion in Constitutional Reference No. 3/1977 makes it clear that a Supply Bill can properly be enacted in such circumstances.

This Bill does not include expenditure provided for by the Supply Act 1977, but makes separate and entirely fresh provision for expenditure from 1st October 1977 to 31st December 1977.

The amounts authorised by the Supply Act, and this Bill, if enacted, will be included, and must be, in the Appropriation Act when enacted. It does not provide for any new services of the Republic.
