AN ACT


To provide for the withdrawal and expenditure of additional monies from the Treasury Fund to meet the expenditure of the Republic for the Financial Year ending on the thirtieth day of June, Two thousand and six.

BE IT ENACTED by the Parliament of Nauru as follows:-


SHORT TITLE


l. This Act may be cited as the Supplementary Appropriation Act 2005-
2006.


INTERPRETATION


2. In this Act:-


‘the Treasury Fund’ means the fund established under Article 58 of the Constitution of Nauru;


‘the Financial Year’ means the year commencing on the first day of July, Two thousand and five and ending on the thirtieth clay of June, Two thousand and

six;


‘head’ means a department or division of the expenditure of the Republic listed in the schedule to this Act’,


‘subhead’ means a subdivision of a head


COMMENCEMENT


3. This Act shall come into force on the eighth day of April, Two thousand and six and shall cease to have effect on the thirtieth day of June, Two thousand and six.


WITHDRAWAL OF MONIES FROM THE TREASURY FUND


4. (1) An additional sum not exceeding $7,990,770 may be withdrawn from the Treasury Fund and expended as authorised in the Schedule to this Act.


(2) The amounts in the Schedule to this Act are in addition to and not in substitution for the amounts authorised by the Appropriation Act 2005-2006.


(3) Where the Cabinet considers it necessary to increase the amount assigned in the estimates to a particular subhead within a Head, the Cabinet may direct that there shall be applied to the aid off that subhead a further sum out of any surplus arising on any other subhead within the same Head, but so that the total amount withdrawn and expended does not exceed the amount authorised for that Head in the Schedule to this Act.


(4) Where the Cabinet authorises a transfer of funds between subheads with a Head in accordance with sub-section (2), it shall cause to be laid before the Parliament at the first meeting of the Parliament after it has approved the transfer, s copy of the order of the Cabinet approving such transfer.
