Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Telecommunications and Regulatory Affairs (Amendment) Act 2017.

2 Commencement

This Act commences upon certification by the Speaker.

3 Amendment of Telecommunications and Regulatory Affairs Act 2017

The Telecommunications and Regulatory Affairs Act 2017 is amended by the provisions of this Act.

4 Amendment of section 4

Section 4 is amended by omitting the current definition of 'national telephone service' and substituting with the following:

'national telephone service' means the national telephone service provided for under section 14;

5 Amendment of section 7

Section 7 is omitted and substituted with the following:

7 Department of Telecommunications and Regulatory Affairs
(1) The Department of Telecommunications and Regulatory Affairs shall be established pursuant to the Public Service Act 2016.
(2) The Department is responsible to the Minister for Telecommunications.

6 Amendment of section 12

Section 12(1) is amended by inserting a new subsection (1)(o) as follows:

'(o) may require every service provider at the end of each financial year to prepare and provide a report giving a true and fair account of its activities, and of its income and expenditure during the year together with an audited statement of accounts for that financial year.'

7 Amendment of section 13

Section 13(1)(a) is amended by omitting the words 'Digicel or any other service provider' and substituting with the words 'an authorised service provider'.

8 Amendment of section 14

Section 14 is omitted and substituted with the following:

14 The national telephone service

The national telephone service consists of:

(a) the telecommunications system provided by an authorised service provider; and
(b) subscriber systems authorised by the Department to be connected to the national telephone service.

9 Amendment of section 45

Section 45 (1)(g) is amended by omitting the figure '28' after the word "section" and substituting the figure '18'.
