Introduction

1. This case was a remittal from the CLAC on 28th May 2013, and then it was filed by the plaintiff Simon Saeni and others.
2. On the other hand, the defendant Moffat Maena and Ruben Kona appeal the determination of the Customary Appeal Court to the High Court.
3. On the 2nd of October 2015, the High Court of the Solomon Island gave its order and the judgment of Appeal.
4. On the 23rd of March 2021, the Local Court listed this case for hearing because the case is filed at the local court by the plaintiff.
5. In the preliminary hearing, the court asked both parties what is the status of the case. In reply, they affirmed to the court that the case is already dealt with in the high court.
6. They also provided a copy of the decision of the high court to confirm to court that the case was already dealt with. They told the court that this case should be withdrawn.
7. As it was confirmed by the two parties that the case should be withdrawn. The Malaita Local court now gives its ruling thr>
