THE CONSTITUTION (AMENDMENT) ACT 2008
Short title and commencement
1. This Act may be cited as the Constitution (Amendment) Act 2008, and is deemed to have come into force on 1 April 2008.
Arrangement of sections and marginal notes amended
2. The Constitution is amended in the Arrangement of Sections by deleting "Prisons" and substituting "Correctional" wherever it appears in sections 119, 123 and 124, including their corresponding marginal notes.
Section 19 amended
3. Section 19 of the Constitution is amended in subsection (1) in paragraph (c) of the definition of "disciplined force", by deleting "Prisons" and substituting "Correctional".
Section 43 amended
4. Section 43 of the Constitution is amended in subsection (2), by deleting "Prisons" and substituting "Correctional".
Section 97 amended
5. Section 97 of the Constitution is amended in subsection (3), by deleting "Prisons" and substituting "Correctional".
Section 116 amended
6. Section 116 of the Constitution is amended in subsection (3)(d), by deleting "Prisons" and substituting "Correctional".
Section 119 amended
7. Section 119 of the Constitution is amended in subsection (1), by deleting "Prisons" and substituting "Correctional".
Section 120 amended
8. Section 120 of the Constitution is amended in subsections (1) and (5) by deleting "Prisons" and substituting "Correctional".
Section 121 amended
9. Section 121 of the Constitution is amended in subsection (1), by deleting "Prisons" and substituting "Correctional".
Section 122 amended
10. Section 122 of the Constitution is amended by deleting "Prisons" and substituting "Correctional".
Section 123 amended
11. Section 123 of the Constitution is amended –
(a) in subsection (1), by deleting 'Prisons Service" and substituting "Correctional Service" appearing twice in that subsection and by deleting "Assistant Prison Officer" and substituting "Inspector";
(b) in subsection (2) –
(i) by deleting "Prisons Service" and substituting "Correctional Service";
(ii) by deleting "Assistant Prison Officer" and substituting "Inspector";
(iii) by deleting "Superintendent of Prisons" and substituting "Commissioner of Correctional Service";
(c) in subsection (3), by deleting "Prisons Service" and substituting "Correctional Service", and by deleting Superintendent of Prisons" and substituting Commissioner of Correctional Service".
Section 124 amended
12. Section 124 of the Constitution is amended –
(a) in subsection (1), by deleting "Prisons" and substituting "Correctional" twice appearing in that subsection;
(b) in subsection (2) –
(i) by deleting "Superintendent of Prisons" and substituting "Commissioner of Correctional Service", and
(ii) by deleting "Prison Officer" and "Assistant Prison Officer" and substituting "Inspector", appearing in paragraphs (a) and (c) respectively;
(iii) by deleting "Assistant Prison Officers" and substituting "Inspectors", appearing in paragraph (b);
(c) in subsection (3) –
(i) by deleting "Superintendent of Prisons" and substituting "Commissioner of Correctional Service" wherever it appears in that subsection;
(ii) by deleting "Prisons Service" and substituting "Correctional Service";
(iii) by deleting "Assistant Prison Officer" and substituting "Inspector".
Section 125 amended
13. Section 125 of the Constitution is amended –
(a) by deleting "Prisons Service" and substituting "Correctional Service";
(b) by deleting "Superintendent of Prisons" and substituting "Commissioner of Correctional Service";
(c) by deleting "Prisons" and substituting "Correctional", in line 6.
Section 125A amended
14. Section 125A of the Constitution is amended in by deleting "Prison Services" and substituting "Correctional Service", appearing twice in that section.
Section 126 amended
15. Section 126 of the Constitution is amended in subsection (5), by deleting "Prisons" and substituting "Correctional".
Section 132 amended
16. Section 132 of the Constitution is amended in subsection (2)(c), by deleting "Prisons" and substituting "Correctional".
Section 144 amended
17. Section 144(1) of the Constitution is amended by repealing the definition of "Prisons Service" and substituting the following definition –
"Correctional Service" means the Correctional Service of Solomon Islands;".
