RE H. WARREN WATKIN DECEASED
(Probate. Skeen C.J. Nukualofa, 16th April, 1913)
No Exemplification of Will – Order for payment of money due to deceased. Mr. Bagnell, Assistant Treasurer moves the Court for instructions. Watkin was Government Treasurer in Tonga and died while in the employment of the Government. There is still £11/8/6 due to him as salary, and under S.185 of the Laws of Tonga this can be paid out until the Court has passed upon it in Probate.
The British Court had allowed the Watkin estate (which was small) to be treated as a small estate without taking out formal Probate, and had handed over the estate in Tonga to the representatives of the deceased, who are now through Mr. Scott had no exemplification of the will.
SKEEN. C.J. Upon the motion paper filed by G. Bagnall and his affidavit also filed in support: application is granted and Order is made that the Treasurer pay the money to Mr. Scott solicitor, who represents the executor in New Zealand.
No fee as application made by Government.
