CHARGED WITH having committed two breaches of Article LIX of the Convention of 1906.


JUDGMENT


The year one thousand nine hundred and twelve, and the tenth day of May, at nine o'clock A.M., the Joint Court composed of the Count of Buena Esperanza, President; G. G. Alexander British Judge & J. Colonna French Judge.

In the presence of C. W. M. Beugel, Public Prosecutor; M. Coursin, Registrar, holding the pen.

Sitting in Police cases pronounced the following judgment:-

THE COURT

After having heard the reading of the documents in the file of the case, and after the Public Prosecutor's' summing up;

WHEREAS, from a report dated 12th February 1912, and from the trial and the evidence of duly sworn witnesses, it follows that the woman Gane (maiden name Liotee) haw, on the 10th. February 1912 at Vila, sold two bottled of wine to the-New Hebrides Native, Pita or Peter; which is a breach Of Article LIX of the Convention and is punishable by Article LXI of the same Convention, the text of which Articles is as follows:-

Art. LIX. (1) "....... no person shall, in the New Hebrides....... sell or supply, intoxicating liquors to the natives, in any form and on any pretext whatsoever".

Art. -LXI. (1). "Any breach by non-natives of Articles 57, 59 and 60 shall be punishable by a fine of from 4/- to £20..."

Therefore sentences the woman Gane (maiden name Liotee) to a fine of one pound (£l) for the offence committed on the 11th February 1911. The said Madame Gane to pay all the costs of the prosecution. The Court acquits her for the offence committed on the 3rd March 1912, the costs in which are to be at the charge of the Condominium.

Thus made judged and pronounced in open Court without appeal, and signed by the Count of Buena Esperanza, President; G. G. Alexander, British Judge; J. Colonna, French Judge and M. Coursin, Acting Registrar.
