JOINT COURT OF THE NEW HEBRIDES
JUDGMENT No. 637
JUDGMENT
This third day of September, one thousand nine hundred and thirty seven;
Before Their Honours:
M. BOSCH-BARRETT, President,
W.D. CAREW, British Judge,
W.A. DOYLEY, French Judge,
Ch. BERTHAULT, Public Prosecutor, ad hoc
assisted by Mr. STEINMETZ, Acting Registrar.
In view of the charge against the said ZACHARIE, native of Erakor, of having at Vila, on Sunday, 10th December 1936, fraudulently stolen a hat from the Tonkinese NGUYEN VIET QUAN.
The Joint Court having questioned the accused and heard his defense, and having heard the witnesses and the address of the Public Prosecutor "ad hoc", then retired.
After having deliberated, decided that on the evidence given, it was not proved that the native ZACHARIE had any intention of committing a theft.
NOW THEREFORE IT IS THIS DAY ADJUDGED:
That the charge against the said ZACHARIE is dismissed and that the costs of the proceedings will be paid by the Condominium Government.
