Joint Court of the New Hebrides |
JOINT COURT OF THE NEW HEBRIDES
Judgment No. 749.
The fourteenth day of May in the year one thousand nine hundred and forty six,
Before Their Honours:
Y. GESLIN, French Judge, President
J. McWHINNEY, British Judge,
and Messrs.
E. LECONTE, Assessor,
E. BUTERI, Public Prosecutor ad hoc,
assisted by
S. DUBOIS, Registrar ad hoc.
This is an application lodged by Alexandre RENEVIER, French citizen living at Santo (New Hebrides) - according to a record made by Mr Chardonnet, Bailiff ad hoc, on 16th February 1946 - for a rehearing of the judgment by default given against him by the Joint Court on 15th January 1946, in which he was sentenced to undergo eight days imprisonment and to pay a fine of five hundred francs for breach of Article 59 of the Anglo-French Protocol of 1914.
The accused was heard in his defence and the Public Prosecutor having delivered his address the Court then retired to consider its judgment.
JUDGMENT
The application for rehearing lodged by Alexandre RENEVIER, having been made in the proper form and within the prescribed period, is admissible.
The evidence in the file and the accused's admission give sufficient proof that he did at Vila on 16th December 1944 supply two bottles of wine to the natives KALPAS and WATLEY, this being a breach of Article 59 of the Anglo-French Protocol of 1914
ON THESE GROUNDS,
The accused is sentenced to pay a fine of one thousand francs with costs five shillings and threepence sterling.
