Public Prosecutor v Nicolas [1946] VUNHJC 3; Civil 744 (15 January 1946)

JOINT COURT OF THE NEW HEBRIDES

Judgment No. 744.


The fifteenth day of January in the year hundred and forty-six,

Before Their Honours:

E. BUTERI, Public Prosecutor ad hoc,

assisted by

S. DUBOIS, Registrar ad hoc.

This is a charge laid against Auguste NICOLAS, French citizen living at Santo, accused of breach of Article 31, para. 7 of the Anglo-French Protocol of 6th August 1914.

The accused, although properly served with a summons on 18th November one thousand nine hundred and forty-five, did not appear nor any person on his behalf.

The Public Prosecutor ad hoc addressed the Court which then retired to consider its judgment.

JUDGMENT

It is shown by the evidence that the accused did at Walla on or about the 23rd day of August 1944 recruit eleven natives without having observed the provisions of Article 31, paragraph 7, of the Protocol of 6th August 1914.

ON THESE GROUNDS,

The accused is convicted by default and sentenced to pay a fine of Five pounds sterling with costs.

At the request of the Public Prosecutor, it is ordered that the accused be notified of the terms of this present judgment.
