The Joint Court thus composed, considered the application made (according to a record dated 11th February, 1946, drawn up by M. CHARDONNET Bailiff "ad hoc" at Santo), by Auguste NICOLAS, French citizen living at Santo, for the rehearing of a judgment (No. 744) given by default on 15th January, 1946, and communicated to accused on 6th February, 1946), in which he was sentenced to pay a fine of FIVE POUNDS Sterling for breach of Article 31 (paragraph 7 of the Anglo-French Protocol of 6th August, 1914.
The accused did not appear and the Court, having heard the Public Prosecutor's address, then gave judgment.
JUDGMENT
The application, lodged by Auguste NICOLAS for rehearing, having been made in the proper form and within the prescribed period, is allowable.
Although personally served with a summons on 10th July, 1947, the accused did not appear nor any person on his behalf.
ON THESE GROUNDS
THE JOINT COURT:
Affirms its judgment (No. 744) given on l5th January, 1946, in which Auguste NICOLAS was sentenced to pay a fine of FIVE POUNDS Sterling.
Costs amounting to one hundred and fifteen francs fifty four centimes to be paid by accused.
