Public Prosecutor v Tauratete [1967] VUNHJC 1; Criminal (A) 03 of 1967 (17 January 1967)

JOINT COURT OF THE NEW HEBRIDES

JUDGMENT No. (A) 3/67
of 17th January, 1967

CONDOMINIUM

v.

FAITHFUL TAURATETE
and
KALSAU ARU of MOSO

JUDGMENT

The two accused were charged that on the 19th October, 1966 on the island of Efate they stole a pig the property of Anthony Hamlyn-Harris, to which charge the accused pleaded guilty.

The Public Prosecutor, Commandant Walford, outlined the facts and told the Court that on the evening of the 19th October the two accused were in the plantation of Mr. Hamlyn-Harris when they saw a pig. It was a young pig, which they chased and caught. They carried this pig, he said, for some distance, but were disturbed by Mr. Hamlyn-Harris (and were seen by a co-villager) and they let the pig go. In clarification of some of the facts outlined to the Court, FAITHFUL TAURATETE told the Court that he was actually carrying the pig along the road when Mr. Hamlyn-Harris approached in his car, and that he then let the pig go.

The pig was recovered the following day.

The first accused, FAITHFUL TAURATETE, is aged fifteen years and the second, KALSAU ARU, twenty. The Court finds the accused guilty as charged and fines each of them £3, together with the costs of the proceedings.

DATED at Vila, this seventeenth day of January, 1967.
