MINUTE

1. Counsel for the defendant informs the Court that Mr. Tari was available earlier but he had to leave to attend another commitment.
   
2. The Court convened at or about 0855 hours this morning and excused the presence of Mr. Tari.
   
3. Ms Warren hands up a draft order signed by Mr. Tari indicating that –
   
   • (a) The matter has been settled by the claimant and defendant; and
   • (b) The claimant discontinues the matter against the defendant.
     
4. Ms Warren confirms settlement and upon invitation by the Court Counsel counter-signs the order.
   

ORDER

5. Accordingly, it is Ordered that –
   
   • (a) Civil Case No. 29 of 2013 be wholly discontinued against the defendant.
   • (b) The proceeding is struck out.
   • (c) There be no order as to costs.
