CONSTITUTION FIRST AMENDMENT ACT NO. 10 OF 1980

1. Amendment of Constitution to provide for the change of name of country and changes in Chapters 8, 13 and 15.

REPUBLIC OF VANUATU
The Constitution First Amendment Act No. 10 1980
To provide for the name of the Republic and to amend Chapters 8, 13 and 15 of the Constitution.
Be it enacted by the President and Parliament as follows:
Amendment of Constitution to provide for the change of name of country and changes in Chapters 8, 13 and 15.
1. The Constitution is amended by –
(a) the substitution of –
(i) the word "Vanuatu" for the words "the New Hebrides" and
(ii) In the English text, except where provided in paragraph (b), the word Ni-Vanuatu for the words "New Hebridean";
(iii) In the French text the word "vanuatuan" for the words "neo-hèbridais";
throughout the Constitution and the making of all necessary grammatical changes as a result thereof;
(b) the substitution of the word "Vanuatu" for the words "New Hebridean" in –
(i) Article 4 (1)
(ii) the twelfth line of Article 10;
(iii) Article 13;
(iv) Article 33.
(c) the substitution of paragraph (2) of Article 45 by the following –
"(2) Except for the Chief Justice' the judiciary shall be appointed by the President acting on the advice of the Judicial Service Commission".
(d) the addition of the following paragraphs to Article 45 –
"(5) Parliament may provide for the appointment by the President of the Republic, after consultation with the Judicial Service Commission, of acting judges for such periods as may be set out in their instruments of appointment.
(6) Paragraph (3) so far as it relates to removal from office shall apply to acting judges";
(e) the revocation of paragraph (4) of Article 47;
(f) the substitution for Article 81 of the following –
"81 The legislation shall provide for the division of the Republic into Local Government Regions and for each region to be administered by a Local Government Council on which shall be representatives of custom chiefs ".
(g) the substitution of –
(i) the words "local government region" for the word "region";
(ii) the words "local government council" for the words "regional council"
(iii) in the English text the word "chairman" or "chairmen" for the word "President" or "Presidents".
throughout the Constitution and the making of all grammatical changes as a result thereof;
(h) the deletion of the words "power and organisation of Regional Councils" from Article 84;
(i) the revocation of Article 94.
Commencement
2. This Act shall come into force on the date of its assent.
