STATUTE LAW (MISCELLANEOUS PROVISIONS) ACT NO. 3 OF 2022

An Act to provide for amendments to certain Acts.

Be it enacted by the President and Parliament as follows-

1. Amendment

The following Acts are amended as set out in the Schedule:

(a) Civil Registration and Identity Management Act No.28 of 2021;
(b) Employment Act [CAP 160];
(c) Foreign Services Act No. 20 of 2013;
(d) Government Contracts and Tenders Act [CAP 245];
(e) Interpretation Act [CAP 132];
(f) Law Reform Commission Act [CAP 115];
(g) Public Health Act [CAP 234];
(h) Public Service Act [CAP 246];
(i) Vanuatu Financial Services Commission Act [CAP 229].

2. Repeal of the Act

(1) This Act is repealed on the day following the day on which all provisions of this Act have commenced.

(2) The repeal of this Act does not, because of the operation of section 11 of the Interpretation Act [CAP 132], affect any amendments made by this Act.

3. Commencement

This Act commences on the day on which it is published in the Gazette.

SCHEDULE

MINOR AMENDMENTS

1 CIVIL REGISTRATION AND IDENTITY MANAGEMENT ACT NO.28 OF 2021

(a) Section 23

Repeal the section.

(b) After paragraph 24(1)

Insert

“(1A) The Registrar-General must not register a change of name for a person who holds dual citizenship.”

2 EMPLOYMENT ACT [CAP 160]

Paragraph 54(1)(d)

Delete “6 consecutive years”, substitute “12 consecutive months”

3 FOREIGN SERVICES ACT NO. 20 OF 2013

Subsection 36(1)

Delete “, by Order,”

4 GOVERNMENT CONTRACTS AND TENDERS ACT [CAP 245]

(a) Section 2 (Interpretation)

Insert in their correct alphabetical positions:

““Declaration of Public Health Emergency” means a Declaration of Public Health Emergency made under section 21A of the Public Health Act [CAP 234];
“state of emergency” has the same meaning as in the Disaster Risk Management Act No. 23 of 2019;”

(b) Paragraph 17(ca)

After “emergency”, insert “or a Declaration of Public Health Emergency”

5 INTERPRETATION ACT [CAP 132]

Subsection 15(5)

Delete “VT20,000”, substitute “VT 1,000,000”

6 LAW REFORM COMMISSION ACT [CAP 115]

Subsections 3A(2) and3B(2)

Delete “3”, substitute “4”

7 PUBLIC HEALTH ACT [CAP 234]

(a) After paragraph 5A(2)(k)

Insert

“(ka) a representative of the Office of the Attorney General nominated by the Attorney General; and”

(b) After subsection 5A(2)

Insert

“(3) The Minister is to appoint the person nominated under paragraph (2)(ka).”

(c) Section 125

Delete “VT 100,000, substitute “VT 1,000,000”

8 PUBLIC SERVICE ACT [CAP 246]

(a) Subsection 18(1)

Repeal the subsection, substitute

“(1) The Commission may appoint a person to be a director or appoint a person to a position equivalent to the position of a director.”

(b) Subsection 18(1A)

Delete “director”, substitute “person appointed under subsection (1)”

(a) Delete “VT12000”, substitute “VT40,000”

(b) Delete “VT10,000”, substitute “VT30,000”
