VANUATU FOREIGN INVESTMENT PROMOTION (AMENDMENT)
ACT NO. 23 OF 2008

An Act to amend the Vanuatu Foreign Investment Promotion Act [CAP 248].

Be it enacted by the President and Parliament as follows:

1 Amendment

The Vanuatu Foreign Investment Promotion Act [CAP 248] is amended as set out in the Schedule.

2 Transitional Arrangement

(1) This section applies to any person who was employed by the Public Service Commission as a staff of the Vanuatu Foreign Investment Authority immediately before the commencement of this Act.

(2) On and after that commencement, the person is to continue to be employed as a staff of the Authority:

(a) on the same terms and conditions; and

(b) in the same position and/or with the same classification.

(3) The transfer of the employment of a person under this section is a transfer from being employed by the Public Service Commission to being employed by the Authority. The transfer is deemed to be a termination of the person’s employment by the Public Service Commission.

(4) To avoid doubt, the person is to be paid any severance or redundancy payments or other entitlements to which the person is entitled under the Public Service Act No.11 of 1998 or any other Act as a result of the termination.

3 Commencement

This Act commences on the day on which it is published in the Gazette.

AMENDMENT OF THE VANUATU FOREIGN INVESTMENT
ACT [CAP 248]

1 Section 21A

Repeal the Section substitute

"21A Staff of the Authority

The staff of the Authority are to be appointed by the Board on such terms and conditions as are determined by the Board."
