AN ACT to amend the Police Service Act 1977.
[29th March 2007]
BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:
1. Short title and commencement-(1) This Act may be cited as the Police Service Amendment Act 2007.
(2) This Act shall come into force on the date of assent of the Head of State.
(3) Notice of commencement of this Act shall be published in Samoan and English in the Savali and one other newspaper circulating in Samoa.
2. Principal Act – In this Act, "Principal Act" means the Police Service Act 1977.
3. Breach of duty by Commissioner, Assistant Commissioner or Superintendent – Section 24 of the Principal Act is amended by omitting subsection (3) and substituting:
"(3) Suspension under this section is with pay.".
4. Suspension of other officers for breach of duty – Section 25 of the Principal Act is amended by omitting subsection (2) and substituting:
"(2) An officer suspended from duty under this section may at any time be reinstated in the Police Service in his old position or any other position.
(3) Suspension under this section is with pay.".
5. Appeals – Section 27 of the Principal Act is amended by omitting subsection (4) and substituting:
"(4) The Board of Appeal, after hearing the appeal, may make such order as it thinks fit, may allow or dismiss the appeal and may vary the penalty imposed on the appellant."
