AN ACT to amend the Samoa Polytechnic Act 1992/1993.
[30 June 1999]
BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:-
1. Short title and commencement - (1) This Act may be cited as the Samoa Polytechnic Amendment Act 1999 and shall be read with and form part of the Samoa Polytechnic Act 1992/1993 (the principal Act).
(2) This Act shall come into force on the date it is assented to by the Head of State.
2. Interpretation - Section 2(1) of the principal Act is amended by deleting the definition of "Board" and replacing it with a definition of "Council" as follows:
""Council" means the Council of the Polytechnic, constituted pursuant to section 7 of this Act."
3. Consequential Amendments - (1) In the principal Act, wherever the word "Board" appears it shall be replaced with the word "Council".
(2) All proceedings, decisions, acts and statutes of the Board of the Polytechnic prior to the commencement of this Act shall remain and have full force and effect, and where necessary shall be read as being proceedings, decisions, acts or statutes of the Council of the Polytechnic.
4. Boards and Committees - (1) Section 15(1) of the principal Act is amended by inserting the words "Boards or" before the words "standing or special committees".
(2) In sections 15 and 16 of the principal Act the words "a Board or" shall be inserted before the words "committee", wherever they appear.
5. Power to make Rules - The principal Act is amended by inserting section 19A as follows:
"19A. Rules - (1) A statute may empower the Council, any Board or Committee of the Council or any officer of the Polytechnic to make rules (not inconsistent with this Act or any statute) providing for the regulation of any matter with respect to which a statute may be made, other than the imposition of any penalty.
(2) Any such rules -
(a) Shall have the same force and effect as a statute; and
(b) May from time to time be amended or repealed by the Council or by the Board, committee or officer empowered to make them."
