Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Parliamentary Salaries and Allowances (Amendment) Act 2019.

2 Commencement

This Act commences on 28 August 2019.

3 Amendment of the Parliamentary Salaries and Allowances Act 2008

The Parliamentary Salaries and Allowances Act 2008 is amended by the provisions of this Act.

4 General amendment as to reference

Any reference to “Assistant Ministers” in this Act is a reference to “Deputy Ministers” as established under the Deputy Ministers Act 2019.

5 Amendment of long title

The long title is deleted and substituted as follows:

‘An Act to provide for the salaries and allowances of the President, Speaker, Ministers, Deputy Speaker, Deputy Ministers and Members of Parliament.’

6 Amendment of section 5

Section 5 is deleted and substituted as follows:

‘5 Salaries and allowances

The salaries and allowances of the President, Speaker, Ministers, Deputy Speaker, Deputy Ministers and Members of Parliament shall be as set out in the Schedules.’

7 Insert new Section 5A

A new Section 5A is inserted as follows:

‘5A Allowances for Deputy Ministers

The Parliament shall fix such allowances as may be appropriate in consideration of the services that the Deputy Ministers shall perform in the exercise of their powers, duties and functions as prescribed under the Deputy Ministers Act 2019.’

8 Amendment of section 7

Section 7 is deleted and substituted as follows:

‘7 Review of salaries and allowances

The salaries and allowances of the President, Speaker, Ministers, Deputy Speaker, Deputy Ministers and Members of Parliament may only be varied by the Parliament by an amendment to:

(a) Schedule 1, which prescribes the salaries; and

(b) Schedule 2, which prescribes the allowances.’

9 Amendment of section 7A

Section 7A(1) is deleted and substituted as follows:

‘(1) The payment of salaries and allowances of the President, Speaker, Ministers, Deputy Speaker, Deputy Ministers and Members of Parliament, may be withheld if such person is suspended from the House.’

10 Amendment of Schedule

(1) The Schedule of the Act is amended by deleting “SCHEDULE” and inserting “SCHEDULE 1 – SALARIES” as follows:

“SCHEDULE 1 – SALARIES”

(2) A new Schedule 2 for the allowances is inserted as follows:

“SCHEDULE 2 – ALLOWANCES”

11 Savings

Save for any amendments made by this Act, the salaries and allowances payable under the Act shall continue as fixed.
