JUDGMENT
The accused, KALUAT JOSEPH, aged 19 years, from Erakor, was charged with, on the 18th/19th May 1974 of breaking and entering a dwelling house to wit the Hotel Le Lagon with intent to steal therein and secondly on the same dates with stealing the sum of two hundred and sixty Australian dollars, seven Fijian dollars and four hundred New Hebrides francs, the property of one Alan Barbour McGill from a room in the said Hotel Le Lagon.
The accused, in answer to the charges, pleaded guilty to both counts.
Mr. Stephens, Native Advocate, on behalf of the accused submitted that accused was not married but had a child by a girl friend whom he was supporting.
The Public Prosecutor informed the Court that accused had two previous convictions one of escaping from lawful custody, for which he was sentenced to three months' imprisonment on the 30th May 1973 and another for taking a car without the owner's consent for which he was sentenced to two months' imprisonment suspended for two years.
After deliberation the Court sentenced the accused to one year's imprisonment on both the first charge and second charge, sentences to be from date of remand and to be concurrent.
